Comments: Editorial: ICC Ruling... Blessing in Disguise

 Appeals judges at the tribunal reversed a decision that prosecutors had not provided enough evidence to add genocide to Al Bashir's charge sheet, ruling that the ICC's pre-trial chamber must look again at whether he should face the charge.

By this timing, the ICC repeated its fault for the second time as it has chosen issuing the decision when Sudan is heading towards a unique democratic process considered as the first of its kind in the country's history.
Threatening the head of the state and the symbol of its sovereignty came in favour of President Al Bashir as it increased his popularity a matter that will make the NCP candidate acquires more votes in the Presidency elections coming April.
It seems that the ICC judges do not know the mentality of the Sudanese people when it comes to targeting their head of state, as they fully support him irrespective of their political motivations.
The appeals judges at the tribunal should have recalled the archives of the press of last March when the arrest warrant for President Al-Bashir was issued when the latter was received by floods of Sudanese citizens of all walks of life when they know by mere accident that he is on his way back from a graduation ceremony in Omdurman.
However, the support came from all political forces being within the GoNU or from opposition parties and that was because the axis of the whole issue here was that selective justice besides the Sudanese morals which dictate devoting lives for the sake of nation's sovereignty.
The timing of the decision could be considered as unfortunate as it comes when everything is speedy progressing in all directions and the whole world is witnessing the positive indications in Sudanese Chadian relations' normalization crowned by the current visit of Idriss Deby and his pledges to support Doha talks, let alone the preparation in full swing for the democratic transformation.
It is expected that the next ruling will reveal there were reasonable grounds to believe that Bashir acted with genocidal intent, and that is because the pre-trial chambers have had enough time to find any evidence to add genocide to Al Bashir's charge sheet.
That means that those who thought that they can use the ICC card in the upcoming elections are betting over the losing horse as the issue is linked with hostile states' interests and has nothing to do with justice or any or its meanings.
To sum up we say that the ICC was mistaken and it gave President Al-Bashir additional popular incentive.
